Welcome to TapTalk.ke, a mobile application designed to assist individuals with limited speech capabilities. This User Agreement (“Agreement”) outlines the terms and conditions governing your use of the TapTalk.ke application (“App”). By downloading, installing, or using the App, you agree to be bound by this Agreement.
By using TapTalk.ke, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, please do not use the App.
TapTalk.ke is a communication assistance tool designed for individuals with limited speech capabilities. The App allows users to create and use customized communication boards to express themselves through tapping or selecting pre-programmed phrases, words, or images.
4.1. The App is intended for use by individuals with limited speech capabilities, their caregivers, and support networks.
4.2. Users must be at least 13 years old to use the App independently. Users under 13 must have parental or guardian consent and supervision.
5.1. You may be required to create an account to use certain features of the App.
5.2. You are responsible for maintaining the confidentiality of your account information and password.
5.3. You agree to notify us immediately of any unauthorized use of your account.
6.1. We are committed to protecting your privacy. Our Privacy Policy, which is incorporated into this Agreement by reference, explains how we collect, use, and disclose your personal information.
6.2. By using the App, you consent to the collection and use of your data as outlined in our Privacy Policy.
7.1. You retain ownership of any content you create or upload to the App.
7.2. By using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content solely for the purpose of providing and improving the App’s services.
You agree not to:
8.1. Use the App for any unlawful purpose or in violation of any applicable laws.
8.2. Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
8.3. Interfere with or disrupt the App’s functionality or servers.
8.4. Attempt to gain unauthorized access to any part of the App or its related systems.
9.1. The App, including its content, features, and functionality, is owned by TapTalk.ke and is protected by copyright, trademark, and other intellectual property laws.
9.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App without our prior written consent.
10.1. The App is provided “as is” and “as available” without any warranties of any kind, either express or implied.
10.2. We do not warrant that the App will be uninterrupted, error-free, or free from harmful components.
To the fullest extent permitted by law, TapTalk.ke shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.
We reserve the right to modify this Agreement at any time. We will notify users of any significant changes. Your continued use of the App after such modifications constitutes your acceptance of the updated Agreement.
We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, for conduct that we believe violates this Agreement or is harmful to other users, us, or third parties, or for any other reason.
This Agreement shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
